DUI, or driving under the influence, is a criminal offense in Illinois that can mean jail time, fines and losing the privilege to drive. Under Illinois law, the first DUI is punishable as a Class A misdemeanor, which carries a jail sentence of up to one year. Multiple or aggravated DUIs are punishable as felonies, which carry jail terms that are longer than one year and larger fines. Lastly, a DUI conviction usually means that the Secretary of State will suspend one’s license.
The Illinois DUI Process
Most people associate DUIs with driving while under the influence of alcohol. However, a police officer can arrest one for a DUI for driving while on any “intoxicating substance” as long as it impairs the ability to operate a motor vehicle. These substances can include illicit and legal substances.
If a police officer suspects that a driver is operating a vehicle while impaired, the police officer will pull the driver over for further investigation. At this point, the officer may administer a field sobriety test, which involves answering a series of questions and performing actions that should be easy for a sober person. The officer may also administer a chemical (breathalyzer) test, which measures the blood alcohol content (“BAC”). In Illinois, the BAC legal limit is .08. If the driver fails the field sobriety or Breathalyzer test, the officer has probable cause to arrest the driver.
Once arrested, the Illinois State’s Attorney charges the driver with a DUI and the criminal process begins.
